A woman came to the Prophet ﷺ and said, "I have committed adultery, so carry out the prescribed punishment on me."He said, "Go away until you have weaned your child."When she had weaned her child, she came back and said, "Messenger of Allah, I have committed adultery, so carry out the prescribed punishment on me."He said, "Bring someone who will take charge of your child."A man stood up and said, "I will take charge of her child, Messenger of Allah."Then he had her stoned.
أن امرأة أتت النبي ﷺ فقالت: إني زنيت، فأقم في الحد، فقال: انطلقي حتى تفطمي ولدك، فلما فطمت ولدها أتت، فقالت: يا رسول الله، إني زنيت، فأقم في الحد فقال: هات من يكفل ولدك؟ فقام رجل فقال: أنا أكفل ولدها يا رسول الله، فرجمها.

Nasai narrated it in Kubra (7149), Daraqutni (3228), and Hakim (4/364), all of them from the hadith of Abu Hamza Muhammad bin Maymun Marwazi Sukkari, from Ibrahim Sayigh, from Abu Zubayr, from Jabir, who said, and then he related the hadith as mentioned. Its chain is hasan because of Ibrahim bin Maymun Sayigh, for his hadith is hasan.What appears evident from the two hadiths is that there is a discrepancy between them regarding the matter of nursing the child. In the first hadith, the Prophet ﷺ postponed carrying out the punishment until the child was weaned, while in the second, a man from the Ansar undertook to provide for the child's nursing. The first hadith settles the matter of the second by showing that what is meant by nursing is full care, except that the narrator did not succeed in expressing it well.This hadith provides evidence for Imam Ahmad's position that the woman is left alone until she gives birth to what is in her womb, and then left for two years until she weans the child. Ishaq held the same view. Abu Hanifa, Malik, and Shafii held that when the pregnant woman gives birth, she is to be stoned.
