Jabir said, "I was among those who stoned him. When he felt the impact of the stones, he panicked terribly, and we mentioned that to the Messenger of Allah ﷺ."The Messenger of Allah ﷺ said, "Why did you not leave him alone?"Muhammad said, "I mentioned this report, as I had heard it, to Asim bin Umar bin Qatada, saying, 'Why did you not leave him alone?'"He said to me, "Hasan bin Muhammad bin Ali bin Abu Talib narrated to me that he heard from some men of Aslam directly that the saying of the Messenger of Allah ﷺ was, 'Why did you not leave Maaz bin Malik alone?'"I did not understand the meaning of the hadith, so I went to Jabir bin Abdullah and said, "Some men of Aslam are telling me that the Messenger of Allah ﷺ said to them, when they mentioned how Maaz panicked from the stones when they struck him, 'Why did you not leave him alone?' I do not accuse the people of falsehood, but I do not understand the hadith."He said, "Nephew, I am the most knowledgeable of people about this hadith. I was among those who stoned the man. When we took him out and stoned him, and he felt the impact of the stones, he cried out to us, 'My people, take me back to the Messenger of Allah ﷺ. My people have killed me and deceived me about my fate. They told me that the Messenger of Allah ﷺ would not put me to death.' But we did not stop until we had killed him. When we went to the Messenger of Allah ﷺ, he said, 'Why did you not leave the man and bring him to me, so that the Messenger of Allah ﷺ could verify the matter from him? As for dropping the prescribed punishment, no.'"
كنت فيمن رجمه فلما وجد مس الحجارة جزع جزعا شديدا فذكرنا ذلك لرسول الله ﷺ قال: فهلا تركتموه؟ قال محمد: فذكرت ذلك من حديثه حين سمعته: ألا تركتموه لعاصم بن عمر بن قتادة فقال لي حدثني حسن بن محمد بن علي بن أبي طالب قال: حدثني ذلك من قول رسول الله ﷺ: ألا تركتموه لماعز بن مالك من ثبت من رجال أسلم قبلا، ولم أعرف وجه حديث فجئت جابر بن عبد الله فقلت: إن رجال أسلم يحدثوني: أن رسول الله ﷺ قال لهم حين ذكروا جزع ماعز من الحجارة حين أصابته: فهلا تركتموه؟ وما أتهم القوم وما أعرف الحديث قال: يا ابن أخي أنا أعلم الناس بهذا الحديث، كنت فيمن رجم الرجل، إنا لما خرجنا به فرجمناه فوجد مس الحجارة، صرخ بنا يا قوم ردوني إلى رسول الله ﷺ فإن قومي قتلوني وغروني من نفسي وأخبروني أن رسول الله ﷺ غير قاتل، فلم ننزع عنه حتى قتلناه. فلما ذهبنا إلى رسول الله ﷺ قال: فهلا تركتم الرجل، وجئتموني به فيتثبت رسول الله ﷺ منه. فأما ترك حد فلا.
Abu Dawud (4420), Nasai in Kubra (7297) [with this wording], and Tahawi in his Mushkil (434) all narrated it from the hadith of Yazid bin Zuray, who said, Muhammad bin Ishaq narrated to us, who said, Muhammad bin Ibrahim narrated to me, from Abu Haytham, and he related it. Abu Dawud added, "Then I understood the meaning of the hadith." Nasai said, "This chain of transmission is better than the one before it."I say, it contains Abu Haytham bin Nasr, from whom no one narrated except Muhammad bin Ibrahim, and no one deemed him reliable, except that he was corroborated in the second narration to which Nasai refers. Muhammad bin Ishaq is a mudallis, but he explicitly stated that he heard it directly.On this subject there is also what was narrated from Musawir bin Ubayd, who said, I came to Abu Barza and said, "Did the Messenger of Allah ﷺ carry out stoning?" He said, "Yes, a man from among us called Maiz bin Malik."Ahmad (19797), Abu Yaala (7431), and Bazzar (3850, Kashf Astar) all narrated it through the route of Awf Arabi, from Musawir bin Ubayd, and he related it. Rawh said, Musawir bin Ubayd Hamani.I say, Musawir bin Ubayd was not deemed reliable by anyone, and he is among the men of Tajeel (1026). Awf Arabi and Isa bin Tahman narrated from him. Ibn Hajar said, "Bukhari and Ibn Abu Hatim distinguished between the one from whom Awf narrated and the one from whom Isa bin Tahman narrated. Of the first they said, he is counted among the people of Basra. Of the second they said, he was the freed slave of Abu Barza Aslami." Ibn Hibban followed him in Thiqat (5/442). On this basis, he is unknown.Likewise, what was narrated from Abu Dharr is not valid, in which the Messenger of Allah ﷺ said to me, "O Abu Dharr, did you not see your companion, he has been forgiven and admitted into Paradise."Ahmad (21554) narrated it from Yazid bin Harun, who said, Hajjaj bin Artah informed us, from Abdul-Malik bin Mughira Taifi, from Abdullah bin Miqdam, from Ibn Shaddad, from Abu Dharr, and he related the hadith in full.It contains Hajjaj bin Artah, who is a mudallis and used the ambiguous "an" form, and Abdullah bin Miqdam bin Ward is among the men of Tajeel (588). Husayni said, "He is not well known," and no narrator from him is mentioned other than Abdul-Malik bin Mughira Taifi. So he is counted among the unknown narrators, and the wording of the hadith contains an oddity.The summary of the story of Maiz Aslami is that he was a married man, and he committed adultery, so the punishment for adultery, which is stoning, was carried out on him. As for the narrators, they differed in recounting this story. Some of them related it from beginning to end, some related only a part of it, and some related only how the punishment was carried out on him.The matter on which no one differed is that the punishment for adultery for a married person is stoning, so this story should not be judged as inconsistent in order to dismiss the punishment for adultery of a married person.And success comes from Allah.
