When Amr bin Saeed dispatched troops to Mecca to fight Ibn Zubayr, Abu Shurayh came to him and spoke with him, informing him of what he had heard from the Messenger of Allah ﷺ. Among the things he reported was that the Prophet ﷺ said, "People of Khuza, hold back your hands from killing, for it has become far too frequent. If you kill anyone, I will pay his blood-money. So whoever is killed after this moment of mine, his family has the choice between two options. If they wish, they may take the life of the killer, or if they wish, they may accept blood-money for him."
لما بعث عمرو بن سعيد إلى مكة، بعثه يغزو ابن الزبير، أتاه أبو شريح فكلمه، وأخبره بما سمع رسول الله ﷺ فمما قال: يا معشر خزاعة ارفعوا أيديكم عن القتل، فقد كثر أن يقع، لئن قتلتم قتيلا لأدينه. فمن قتل بعد مقامي هذا فأهله بخير النظرين: إن شاؤوا فدم قاتله، وإن شاؤوا فعقله.
Imam Ahmad narrated it (16377) from Yaqub, who said, my father narrated to me, from Muhammad bin Ishaq, who said, Saeed bin Abu Saeed Maqburi narrated to me, from Abu Shurayh Khuzai, who mentioned it in the long sermon he gave on the day of the conquest. Its chain is hasan due to Muhammad bin Ishaq.This hadith was also narrated with another chain and another wording, from Muhammad bin Ishaq, from Harith bin Fudayl, from Sufyan bin Abu Awja, from Abu Shurayh Khuzai, who said, the Messenger of Allah ﷺ said, "Whoever suffers bloodshed or injury has the choice between one of three options, and if he wants a fourth, restrain his hands. He may have the offender killed, or forgive him, or take blood money. Whoever does one of these and then reverts, for him is the fire of Hell, abiding therein forever and ever."Abu Dawud narrated it (4496), and Ibn Majah (2623), and Ahmad (16375), and Daraqutni (3/96), all of them by this route. Sufyan bin Abu Awja is daif according to the majority of scholars. Dhahabi counted this hadith among his objectionable narrations in Al-Mizan (2/169–170). It also contains Muhammad bin Ishaq, who is a mudallis, and he narrated it using the form "an" (indicating a possible gap in the chain).
