Hani's son reported, on the authority of his father, that when he came as part of a delegation to the Messenger of Allah ﷺ, he heard the people calling Hani by the nickname Abu Hakam. The Messenger of Allah ﷺ summoned him and said to him, "Indeed, Allah alone is the Judge, and to Him belongs all judgment. So why are you nicknamed Abu Hakam?"He replied, "When my people differ over something, they come to me, and I judge between them, and both parties are pleased with my decision."The Prophet ﷺ said, "How excellent this is. What children do you have?"He answered, "I have Shurayh, Abdullah, and Muslim."The Prophet ﷺ asked, "Which of them is the eldest?"He replied, "Shurayh."The Prophet ﷺ said, "Then you are Abu Shurayh." And he supplicated for him and his children.
عن أبيه، أنه لما وفد إلى رسول الله ﷺ وسمعه وهم يكنون هانئا أبا الحكم. فدعاه رسول الله ﷺ فقال له: إن الله هو الحكم، وإليه الحكم، فلم تكنى أبا الحكم؟ قال: إن قومي إذا اختلفوا في شيء أتوني فحكمت بينهم، فرضي كلا الطرفين. قال: ما أحسن من هذا، فمالك من الولد؟ قال: لي شريح، وعبد الله ومسلم، قال: فمن أكبرهم؟ قال شريح، قال: فأنت أبو شريح فدعا له ولولده.
Nasai narrated it (5387), from Qutayba, who said, Yazid, that is, the son of Miqdam bin Shurayh, told us, from his father, from Shurayh bin Hani, from his father, and he mentioned it. Its chain of transmission is sahih. Arbitration has been established as valid in the matter of spouses, in the penalty for hunting game, and in Saad's arbitration in the case of Banu Qurayza. Arbitration is permissible but not binding, it is merely a ruling for the two parties, if they wish they may act upon it, and if they do not wish to, they may resort to the ruler.
