I was sitting with Aswad bin Yazid in the great mosque, and Shaybi was with us. Shaybi narrated the hadith of Fatimah bint Qays, that the Messenger of Allah ﷺ did not grant her lodging or maintenance.Aswad then took a handful of pebbles and threw them at him, saying, "Woe to you! Do you narrate something like this? Umar said, 'We will not abandon the Book of Allah and the Sunnah of His Prophet ﷺ for the statement of a woman, not knowing whether she remembered or forgot. She is entitled to lodging and maintenance.' Allah said, 'Do not expel them from their houses, nor shall they leave, unless they commit a clear indecency' [Talaq 65:1]."
كنت مع الأسود بن يزيد جالسا في المسجد الأعظم ومعنا الشعبي، فحدث الشعبي بحديث فاطمة بنت قيس أن رسول الله ﷺ لم يجعل لها سكنى ولا نفقة، ثم أخذ الأسود كفا من حصى فحصبه به، فقال: ويلك! تحدث بمثل هذا؟ قال عمر: لا نترك كتاب الله وسنة نبيه ﷺ لقول امرأة لا ندري لعلها حفظت أو نسيت، لها السكنى والنفقة. قال الله عز وجل: {لا تخرجوهن من بيوتهن ولا يخرجن إلا أن يأتين بفاحشة مبينة}
Muslim narrated it (46:1480) from Muhammad bin Amr bin Jabalah, who said, our teacher Abu Ahmad narrated to us, our teacher Ammar bin Raziq narrated to us, from Abu Ishaq, with the same chain, and he related it.Regarding the phrase "and the sunnah of our Prophet," Daraqutni said it is shadhdh, since a group of trustworthy narrators did not mention it. As for what appears in some books of the jurists, and in Tahawi's commentary (39/2), "perhaps she lied," this too is shadhdh, and the narrator erred in it. The correct wording, as found in Sahih Muslim, is "perhaps she remembered or forgot."
