A man pronounced the zihar oath against his wife, then had relations with her before offering the expiation. He came to the Prophet ﷺ and mentioned what had happened.The Prophet ﷺ asked him, "What drove you to do this?"He replied, "Messenger of Allah, I saw the whiteness of her ankles in the moonlight, and I could not restrain myself from being intimate with her."The Prophet ﷺ laughed and ordered him not to approach her until he had made the expiation.
أن رجلا ظاهر من امرأته فغشيها قبل أن يكفر، فأتى النبي ﷺ، فذكر ذلك، فقال: ما حملك على ذلك؟ فقال: يا رسول الله! رأيت بياض حجليها في القمر، فلم أملك نفسي أن وقعت عليها، فضحك النبي ﷺ وأمره ألا يقربها حتى يكفر.
Reported by Tirmidhi (1199), Ibn Majah (2065), Nasai (3457), and Abu Dawud (2225/2223) (except that he did not mention the wording of the hadith), and Hakim (2/204) and Bayhaqi (7/386), all of them from the hadith of Hakam bin Abban, from Ikrima, from Ibn Abbas, and he mentioned it.Its chain is hasan because of Hakam bin Abban, for he is hasan al-hadith. Tirmidhi said, "Hasan gharib sahih." Al-Hafiz also graded it hasan in Fath al-Bari (9/433), except that Abu Dawud did not mention Ibn Abbas in his two narrations. He related them from Sufyan bin Uyayna and Ismail, both of them from Hakam bin Abban, from Ikrima, who said, a man made zihar declaration against his wife, and he mentioned it.He said, and I heard Muhammad bin Isa narrating it, Mutamir related to us, saying, I heard Hakam bin Abban narrate this hadith, and he did not mention Ibn Abbas, he said it from Ikrima.Abu Dawud said, "Husayn bin Hurayth wrote to me, saying, Fadl bin Musa informed us, from Mamar, from Hakam bin Abban, from Ikrima, from Ibn Abbas, with its meaning, from the Prophet ﷺ." End of quote.I say, and from this route it was extracted by Tirmidhi and the aforementioned Nasai, and Fadl bin Musa Sinani is trustworthy and firmly established, so his addition is accepted.Ibn Abbas said, "In the pre-Islamic era, when a man said to his wife, 'You are to me like the back of my mother,' she became forbidden to him. The first person to make a zihar declaration in Islam was Aws bin Samit."
