The Messenger of Allah ﷺ cursed the man who marries a divorced woman in order to make her lawful for her former husband, and the one for whom this is done.

This was narrated by Tirmidhi (1120), Nasai (3416), Ahmad (4248), and Bayhaqi (20/7), all of them through the hadith of Sufyan Thawri, from Abu Qays, from Hazeel, from Abdullah, who mentioned it. Hazeel is Ibn Shurahbil Awdi, one of the men of Bukhari, a trustworthy successor who lived in both the pre-Islamic and Islamic eras.Tirmidhi said, "This is a hasan sahih hadith. Abu Qays Awdi's name is Abdul-Rahman bin Tharwan. This hadith has been narrated from the Prophet ﷺ through more than one route, and the practice among the scholars from the companions of the Prophet ﷺ is in accordance with this hadith. Among them are Umar bin Khattab, Uthman bin Affan, Abdullah bin Amr, and others. This is also the view of the jurists among the successors, and it is held by Sufyan Thawri, Ibn Mubarak, Shafii, Ahmad, and Ishaq.I heard Jarud bin Muaz mention, on the authority of Waki, that he held this view and said, 'This matter should be thrown back at the statements of the people of personal opinion.' Waki said, and Sufyan said, 'If a man marries a woman in order to make her lawful for her former husband, and then decides he wants to keep her, it is not lawful for him to keep her except through a new marriage contract.'"
