The Prophet ﷺ forbade that a woman be married while her paternal aunt is already married to the same man, or that a paternal aunt be married while her brother's daughter is already married to him, or that a woman be married while her maternal aunt is already married to him, or that a maternal aunt be married while her sister's daughter is already married to him. The younger may not be married over the elder, nor the elder over the younger.
عن النبي ﷺ نهى أن تنكح المرأة على عمتها، أو العمة على ابنة أخيها، أو المرأة على خالتها، أو الخالة على ابنة أختها، ولا تنكح الصغرى على الكبرى، ولا الكبرى على الصغرى.
Abu Dawud (2065), Tirmidhi (1126), Nasai (3296), Ibn Abu Shayba (246/4), Ibn Nasr Marwazi in Sunnah (239), Ibn Jarud (685), and Ibn Hibban (4117) all narrated it, all of them through the hadith of Dawud bin Abu Hind, "Amir Shaybi narrated to us, from Abu Hurairah," and he related it.Tirmidhi said, "Hasan sahih." And he said, "Shaybi met Abu Hurairah and narrated from him. I asked Muhammad about this, and he said, "Sahih."" Tirmidhi also said, "Shaybi also narrated it from a man, from Abu Hurairah." End.The hadith of Ibn Awn, from Shaybi, from Abu Hurairah, was narrated by Bayhaqi (166/7), who said, "Bukhari did include the narration of Asim Ahwal, from Shaybi, from Jabir bin Abdullah, but they consider it a mistake, holding that the correct version is the narration of Dawud bin Abu Hind and Abdullah bin Awn, from Shaybi, from Abu Hurairah."Ibn Turkmani disputed this, saying, "It is possible that Shaybi heard it from both of them, that is, from Abu Hurairah and from Jabir, and this is preferable to declaring one of the two paths mistaken, for if that were the case Bukhari would not have included it in his Sahih. Moreover, there is disagreement about the narration transmitted from Dawud bin Abu Hind on this point, for it has been narrated from him, from Shaybi, as Bayhaqi mentioned, and Muslim included it from his hadith, from Ibn Sirin, from Abu Hurairah. And it does not follow, from the fact that the two Shaykhs did not include something, that it cannot be sahih, as is well known."The hadith of Abu Hurairah has another path, which is what Tirmidhi related in Ilal al-Kabir (443/1–444), from Muhammad bin Ala, "Muhammad bin Salt narrated to us, from Mindal, from Amash, from Abu Salih, from Abu Hurairah," and he mentioned the hadith.Tirmidhi said, I asked Muhammad about this hadith, and he said, "Mindal is daif in hadith, I do not write down his hadith," as though he did not recognize this hadith as coming from the hadith of Amash, from Abu Salih, from Abu Hurairah, by any other route.
