A man came to the Prophet ﷺ and said, "My wife does not refuse the hand of anyone who touches her."He replied, "Send her away if you wish."The man said, "I fear my heart will follow her."He said, "Then enjoy her company."
جاء رجل إلى النبي ﷺ فقال: إن امرأتي لا تمنع يد لامس. فقال: غربها إن شئت. قال: إني أخاف أن تتبعها نفسي، قال: استمتع بها.
Abu Dawud (2049), Nasai (3464), and Bayhaqi (7/154), by the route of Abu Dawud, reported this, both of them from Husayn bin Hurayth Marwazi, who said, Fadl bin Musa narrated to us, from Husayn bin Waqid, from Umara bin Abu Hafsa, from Ikrima, from Ibn Abbas, and he mentioned it. Except that Abu Dawud said, "Husayn bin Hurayth Marwazi wrote to me," meaning that he narrated it from him in writing.Its chain of narration is hasan because of Husayn bin Waqid, for although he is among the narrators found in Muslim's collection, he is hasan al-hadith and does not rise to the level of "trustworthy."Bayhaqi also reported it through another route from Abu Abdullah Saffar Wazzan, who said, Husayn bin Hurayth narrated to us with his chain, and in it is the wording, "So enjoy her then." He said, "The word 'then' does not appear in the narration of Abu Dawud."The hadith has other chains as well. Among them is what Nasai (3465) reported from Ishaq bin Ibrahim, who said, Nadr bin Shumayl narrated to us, who said, Hammad bin Salama narrated to us, who said, Harun bin Riab informed us, from Abdullah bin Ubayd bin Umayr, from Ibn Abbas, that a man said, "Messenger of Allah, I have a wife under me who does not repel the hand of any man who touches her." He said, "Divorce her." The man said, "I cannot bear to be without her." He said, "Then keep her." Nasai said, "This is a mistake, and the correct version has the Companion omitted from the chain."Among them also is what he reported again (3229) from Muhammad bin Ismail bin Ibrahim, who said, Yazid narrated to us, who said, Hammad bin Salama and others narrated to us, from Harun bin Riab, from Abdullah bin Ubaydullah bin Umayr, and Abdul-Kareem, from Abdullah bin Ubaydullah bin Umayr, from Ibn Abbas. Abdul-Kareem traces it back to Ibn Abbas, while Harun does not trace it back. Both of them said, "A man came to the Messenger of Allah ﷺ and said, 'I have a wife who is among the people most dear to me, and she does not repel the hand of any man who touches her.' He said, 'Divorce her.' The man said, 'I cannot bear to be without her.' He said, 'Then enjoy her.'"Among them also is what Bayhaqi reported through another route from Hammad bin Salama, who said, Abdul-Kareem bin Abu Mukhariq and Harun bin Riab Asadi narrated to us, from Abdullah bin Ubayd bin Umayr Laythi. Hammad said, "One of the two said, from Ibn Abbas, that a man said, 'Messenger of Allah, I have a beautiful cousin, and she does not repel the hand of any man who touches her.' He said, 'Divorce her.' The man said, 'I cannot bear to be without her.' He said, 'Then keep her.'" He said, "Ibn Uyayna narrated it from Harun bin Riab with the Companion omitted from the chain."Nasai said, "This hadith is not firmly established. Abdul-Kareem is not strong, while Harun bin Riab is more reliable than him, though he narrated the hadith with the Companion omitted from the chain. Harun is trustworthy, and his narration is more likely to be correct than that of Abdul-Kareem." End of quote.I say, it is as he said, for Abdul-Kareem, that is Ibn Abu Mukhariq, is daif according to the majority of scholars. As for Harun bin Riab, with a kasra on the ra, Tamimi, he is trustworthy. Ahmad, Ibn Main, Nasai, and others declared him trustworthy. Ibn Uyayna, Hammad bin Salama, and others narrated from him with the Companion omitted from the chain, except that this narration, despite the omission, strengthens the narration of Husayn bin Hurayth Marwazi mentioned earlier at the beginning of the hadith, due to the difference in their sources, as is established in the science of hadith terminology.If this is established, then Nasai's statement, "This hadith is not firmly established," is to be understood as applying to the two chains he presented, otherwise the hadith is hasan by the first chain as mentioned before, and Nasai remained silent about it there.Nawawi declared it sahih, as found in Talkhees (3/225), perhaps due to the combined strength of these various routes.
