The Messenger of Allah ﷺ said, "A previously married woman has more right over herself than her guardian, and a virgin's permission must be sought regarding herself, and her silence is her consent."
أن رسول الله ﷺ قال: الأيم أحق بنفسها من وليها، والبكر تستأذن في نفسها، وإذنها صماتها.
Malik narrated it in the Book of Marriage (4), from Abdullah bin Fadl, from Nafi bin Jubayr bin Mutim, from Abdullah bin Abbas, as mentioned. Muslim narrated it in the Book of Marriage (66:1421) through routes from Malik, with the same wording.
