Ayesha said, "I asked the Messenger of Allah ﷺ about a young woman whose family wishes to marry her off, whether her consent should be sought or not."The Messenger of Allah ﷺ replied, "Yes, her consent must be sought."Ayesha said, "I said to him, 'But she would be too shy to speak.'"The Messenger of Allah ﷺ said, "Her silence is her consent."
سألت رسول الله ﷺ عن الجارية ينكحها أهلها، أتستأمر أم لا؟ فقال لها رسول الله ﷺ: نعم تستأمر فقالت عائشة: فقلت له: فإنها تستحي فقال رسول الله ﷺ: فذلك إذنها إذا هي سكتت.
Bukhari reported it in the Book of Marriage (5137) via Layth, and Muslim (1420) via Ibn Jurayj, both from Ibn Abu Mulayka, who said, Zakwan, the freed slave of Ayesha, said, I heard Ayesha say, then he mentioned it. The wording given here is that of Muslim.Bukhari's wording has her saying, "Messenger of Allah, a virgin feels shy." He said, "Her consent is her silence."In other narrations, "Consult women about their marriages." This was reported by Ibn Hibban in his Sahih (4080) and others.
