A woman from the descendants of Jafar feared that her guardian would marry her off against her will, so she sent word to two elders of the Ansar, Abd al-Rahman and Majma, the two sons of Jariya.They said, "Do not be afraid, for Khansa bint Khidam was given in marriage by her father against her will, and the Prophet ﷺ annulled that marriage."Sufyan said, "As for Abd al-Rahman, I heard him relate from his father that Khansa..."
إن امرأة من ولد جعفر، تخوفت أن يزوجها وليها وهي كارهة، فأرسلت إلى شيخين من الأنصار: عبد الرحمن ومجمع ابني جارية، قالا: فلا تخشين! فإن خنساء بنت خدام أنكحها أبوها وهي كارهة، فرد النبي ﷺ ذلك. قال سفيان: وأما عبد الرحمن فسمعته يقول عن أبيه: إن خنساء.
Bukhari narrated it in the chapter on legal tricks (6969), from Ali bin Abdullah, who said, Sufyan narrated to us, Yahya bin Saeed narrated to us, from Qasim, that a woman from the descendants of Jafar... and he mentioned it. Qasim here is Ibn Muhammad bin Abu Bakr Siddiq. As for Sufyan's statement, "As for Abdul-Rahman," he means Abdul-Rahman bin Qasim bin Muhammad bin Abu Bakr. And his statement, "I heard him say, from his father, that Khansa," he transmitted it without a direct chain, not mentioning in it Abdul-Rahman bin Yazid or his brother.Ibn Hajar mentioned this in Fath al-Bari (12/341) and said, Ibn Abu Umar reported it in his Musnad, and through his route Ismaili reported it, saying, from Sufyan, from Yahya bin Saeed and Abdul-Rahman bin Qasim, that Khansa... and he mentioned it, but shortened its chain. He said, and previously mentioned was Malik's narration from Yahya bin Saeed with a connected chain. End of quote. This is what he said regarding Malik's narration, but Malik only reported it in Muwatta from Abdul-Rahman bin Qasim, and through his route Bukhari reported it in the chapter on marriage as previously mentioned.However, Bukhari also reported it in the chapter on marriage right after it (5139), from Ishaq, Yazid informed us, Yahya informed us, that Qasim bin Muhammad told him that Abdul-Rahman bin Yazid and Mujammi bin Yazid told him that a man who was a servant married off a daughter of his... and he did not relate the rest of the wording. Ishaq here is Ibn Rahawayh. Yazid is Ibn Harun. Yahya is Ibn Saeed Ansari.Through the route of Yazid bin Harun, Ahmad also narrated it (26789), relating its wording in full, and in it, "So she married Abu Lubaba bin Abdul-Mundhir." Yahya mentioned that it had reached him that she had been previously married.A detailed account of this was narrated in the hadith of Hajjaj bin Saaib bin Abu Lubaba bin Abdul-Mundhir Ansari, that his grandmother Umm Saaib Khunas bint Khidam bin Khalid had been married to a man before Abu Lubaba, and she became a widow from him. Her father Khidam bin Khalid married her to a man from Banu Amr bin Awf bin Khazraj, but she refused, insisting on going to Abu Lubaba instead, while her father refused, insisting she stay with Awfi, until the matter was brought before the Messenger of Allah . The Messenger of Allah
said, "She has more right over her own affair," and so he let her follow her own preference. He said, so she separated from Awfi and married Abu Lubaba, and bore him Abu Saaib bin Abu Lubaba.Imam Ahmad narrated it (26790), saying, I read to Yaqub bin Ibrahim, who said, my father narrated to us, from Ibn Ishaq, who said, Hajjaj bin Saaib narrated to me, and he mentioned it. Ibn Ishaq here is Muhammad bin Ishaq, a mudallis, though here he explicitly stated his hearing. However, his teacher Hajjaj bin Saaib was not authenticated by anyone except Ibn Hibban, and no one narrated from him except Ibn Ishaq. He is among the men mentioned in Taajil. Abu Hatim said of him, "Unknown," in Jarh wat-Tadil (3/161). Moreover, its chain contains a break.However, Daraqutni narrated it (3/231), and from him Bayhaqi (7/119), from the hadith of Muhammad bin Ishaq, adding in it, from his father, from his grandmother Khansa bint Khidam bin Khalid, and he related the hadith.It was also narrated from Ibn Abbas, who said, Khidam Abu Wadia married off his daughter to a man, and she came to the Prophet
and complained to him that she had been married against her will. So the Prophet
separated her from her husband, and said, "Do not force them into marriage." He said, so after that she married Abu Lubaba Ansari, and she had been previously married.Imam Ahmad narrated it (3440), from Abdul-Razzaq, and it is also found in his Musannaf (10308), Ibn Jurayj informed us, saying, Khurasani informed us, from Ibn Abbas, and he mentioned it. Khurasani here is Ata bin Abu Muslim, who did not hear directly from Ibn Abbas. Abu Dawud said in his Marasil (341), regarding a hadith narrated by Ata Khurasani from Ibn Abbas, who said, the Messenger of Allah
said, "No bequest may be made to an heir, unless the heirs consent to it," that Ata Khurasani never met Ibn Abbas nor saw him, and likewise Ahmad and Ibn Main and others said the same.
