"If he leaves wealth, that he should make a bequest for the parents and near relatives" [Baqarah 2:180]. The bequest remained obligatory in this way until the verse of inheritance abrogated it.
{إن ترك خيرا الوصية للوالدين والأقربين} فكانت الوصية كذلك حتى نسختها آية الميراث.
Abu Dawud (2869) narrated it, and through his route Bayhaqi (6/265), from Ahmad bin Muhammad bin Thabit Marwazi, who said, "Ali bin Husayn bin Waqid narrated to me," from his father, from Yazid Nahwi, from Ikrima, from Ibn Abbas, and he related it.Its chain is hasan because of Ali bin Husayn bin Waqid and his father, for their narrations are graded hasan.The bequest was obligatory before the revelation of the verse of inheritance, then it was abrogated for heirs, remaining recommended for non-heirs. This is the view of the majority of the scholars, except when the person has a debt owed, or holds something entrusted to him, or a deposit in his care, in which case he must make a bequest concerning it in order to preserve the rights of others.
