The Prophet ﷺ said, "There is no believer except that I am closer to him than anyone else in this world and the next. Recite if you wish, 'The Prophet is closer to the believers than their own selves' [Ahzab 33:6]. So whichever believer dies leaving wealth, let his paternal relatives inherit it, whoever they may be. But whoever leaves behind a debt or dependents, let him come to me, for I am his guardian."
أن النبي ﷺ قال: ما من مؤمن إلا وأنا أولى به في الدنيا والآخرة، اقرؤوا إن شئتم: {النبي أولى بالمؤمنين من أنفسهم} [سورة الأحزاب: ٦] فأيما مؤمن مات وترك مالا فليرثه عصبته من كانوا، ومن ترك دينا أو ضياعا فليأتني فأنا مولاه.
Bukhari related it in the chapter on borrowing (2399), from Abdullah bin Muhammad, who said, "Abu Amir related to us, Fulayh related to us, from Abu Hazim, from Abu Hurairah," and he mentioned it.His saying, "let his heirs inherit it," means the heirs in general, not specifically those who inherit through agnatic succession (tasib). This is because the agnate (asib) in technical usage is one who has no fixed share among those unanimously agreed to inherit, who inherits the entire estate if he is the sole heir, and who inherits whatever remains after the fixed shares have been distributed, by virtue of agnatic succession.What is meant by "the asabah" here is the man's kinsmen, meaning those who share a common ancestor with the deceased, however far back that ancestor may be. They are called by this name because they surround him. It is said, "so-and-so's asabah gathered around him," meaning they surrounded him.See Fath al-Bari (10/12).
