The Messenger of Allah ﷺ said, "The umra is valid for the one to whom it is given, and the ruqba is valid for the one to whom it is given."
قال رسول ﷺ العمرى جائزة لأهلها، والرقبى جائزة لأهلها.
Reported by Abu Dawud (3558), Tirmidhi (1351), Ibn Majah (2383), and Nasai (3739), all from the hadith of Dawud bin Abu Hind, from Abu Zubayr, from Jabir, who related it.Tirmidhi said, "This is a hasan hadith. Some have reported it from Abu Zubayr, from Jabir, as a stopped narration, without raising it to the Prophet ﷺ." He also said, "The practice among some scholars from among the companions of the Prophet ﷺ and others is that ruqba is permissible, just like umra, and this is the view of Ahmad and Ishaq."Shafii also held this view, while Abu Hanifa and his companions held that ruqba is not permissible. They said that it is a loan that cannot be inherited.Ruqba is when a man grants something on the condition that whichever of the two parties dies first, it goes to the other, so each of them watches for the death of the other.
