A woman in Madinah granted a walled garden of hers to her son as a life-grant. He then died, and she died after him, leaving a child behind. He had brothers who were sons of the woman who had made the grant.The son of the grantee said, "The garden returns to us."The sons of the grantor said, "Rather, it belonged to our father in his life and after his death."They brought their dispute to Tariq, the freedman of Uthman. He summoned Jabir, who testified that the Messenger of Allah ﷺ had ruled that a life-grant belongs to the one to whom it was given. So Tariq judged accordingly, then wrote to Abdul-Malik informing him of the matter and of Jabir's testimony.Abdul-Malik replied, "Jabir has spoken the truth."Tariq then carried out the ruling, and that garden has belonged to the sons of the grantee to this day.
أعمرت امرأة بالمدينة حائطا لها ابنا لها، ثم توفي وتوفيت بعده، وتركت ولدا، وله إخوة بنون للمعمرة، فقال ولد المعمرة: رجع الحائط إلينا. وقال بنو المعمر: بل كان لأبينا حياته وموته. فاختصموا إلى طارق مولى عثمان، فدعا جابرا، فشهد على رسول الله ﷺ بالعمرى لصاحبها، فقضى بذلك طارق، ثم كتب إلى عبد الملك، فأخبره ذلك، وأخبره بشهادة جابر، فقال عبد الملك: صدق جابر. فأمضى ذلك طارق، فإن ذلك الحائط لبني المعمر حتى اليوم.
Muslim narrated it in the Book of Gifts (1625:28) through various routes from Abdul-Razzaq, who said, "Ibn Jurayj informed us, who said, Abu Zubayr informed me, from Jabir," and he mentioned it.
