The Messenger of Allah ﷺ forbade withholding the surplus water of a well, meaning the excess water.
نهي رسول الله ﷺ أن يمنع نقع البئر، يعني فضل الماء.
It was narrated by Ahmad (26311) and Ibn Hibban (4955), both from the hadith of Muhammad bin Ishaq, who said, "Abu Rijal Muhammad bin Abdul-Rahman bin Haritha Ansari told me, from his mother Amra bint Abdul-Rahman, from Ayesha," and he related it.Muhammad bin Ishaq is a mudallis, but he explicitly stated "he told me" in Ahmad's narration. Moreover, he was not alone in narrating it, for he was corroborated by each of the following.Abu Uways, that is, Abdullah bin Abdullah bin Uways Asbahi, narrated it from Abu Rijal with the same chain, and Ahmad (24811) narrated it through his route.Abdul-Rahman bin Abu Rijal said, "I heard my father narrating from his mother Amra, from Ayesha," and he related it. Hakim narrated it through this route (2/61) and said it was sahih al-isnad.Abdah bin Sulayman, from Haritha, from Amra with the same chain, narrated it likewise. Ibn Majah (2479) narrated it. Haritha is the son of Abu Rijal, and he is daif according to the majority of the scholars.Sufyan Thawri, from Abu Rijal, from Amra with the same chain, narrated it likewise. Bayhaqi (6/152) narrated it and said, "This is how he presented it as connected, but it is only known as connected through the hadith of Abdul-Rahman bin Abu Rijal, from his father." He then narrated it through the route of Abdul-Rahman bin Abu Rijal and said, "Likewise Muhammad bin Ishaq bin Yasar narrated it from Abu Rijal as connected. Haritha bin Muhammad also narrated it from Amra as connected, except that Haritha is daif."The conclusion is that the hadith is sahih or hasan as a connected narration. However, Malik narrated it in Aqdiyah (32) from Abu Rijal Muhammad bin Abdul-Rahman, from his mother Amra bint Abdul-Rahman, that she informed him that the Messenger of Allah ﷺ said, "The surplus water of a well may not be withheld." He narrated it this way as mursal.Ibn Abdul-Barr said in Tamhid (13/123), "I do not know of anyone among the narrators of Muwatta from Malik who connected this hadith to him with a full chain, for it is mursal according to all of them, as far as I know, in this manner." He also said, "Daraqutni mentioned it from Abu Said, from Abu Ali Jarmi, from Abu Salih the scribe of Layth, from Layth bin Saad, from Saeed bin Abdul-Rahman Jumahi, from Malik bin Anas, from Abu Rijal Muhammad bin Abdul-Rahman bin Haritha, from his mother Amra bint Abdul-Rahman, from Ayesha, that the Messenger of Allah ﷺ forbade withholding the surplus water of a well. This chain, though unusual coming through Malik, was also narrated by Abu Qurra Musa bin Tariq, from Malik as well." End of quote.He then proceeded to trace the hadith's chain through the routes that had already been partly mentioned.As for his saying, "The surplus water of a well may not be withheld," this means the extra water beyond what is needed, and this explanation has not been disputed in its general sense. Indeed, it has come in this very form within the connected wording of the hadith. The surplus water of a well is what remains in it after its owner has taken what he needs.As for the saying, "The surplus water may not be withheld in order to withhold pasture by means of it," its meaning is that if there is pasture around a well with no other source of water nearby, and the owners of livestock cannot graze their animals there unless they are able to water them from that well, then to prevent them from the water would necessarily prevent them from the pasture as well, since after grazing the animals would suffer from thirst. This is the explanation given by the majority of scholars, as Ibn Hajar stated in Fath al-Bari (5/32).
