The Messenger of Allah ﷺ permitted the sale of unpicked dates on the tree in exchange for an estimated equivalent in dried dates, in quantities of less than five Awsuq, or up to five Awsuq.
أن رسول الله ﷺ أرخص في بيع العرايا بخرصها فيما دون خمسة أوسق، أو في خمسة أوسق.
Malik narrated it in the Book of Sales (14) from Dawud bin Husayn, from Abu Sufyan, the freed slave of Ibn Abu Ahmad, from Abu Hurairah, who related it.Bukhari narrated it in the Book of Sales (2190), and Muslim in the Book of Sales (1541), both of them by way of Malik, in a similar manner.Muslim added, Dawud was in doubt, saying, "Five, or less than five."
