The Messenger of Allah ﷺ said, "Whoever has a partner in a property or a date palm grove may not sell his share until he informs his partner. If the partner is willing, he may take it, and if he is not, he may leave it."
قال رسول الله ﷺ: من كان له شريك في ربعة أو نخل فليس له أن يبيع حتى يؤذن شريكه، فإن رضي أخذ، وإن كره ترك.
Muslim narrated it in the Book of Sharecropping (1608: 133) from the hadith of Zuhayr Abu Khaythama and Ibn Jurayj, both of them from Abu Zubayr, from Jabir. This is the wording of Zuhayr Abu Khaythama. The wording of Ibn Jurayj is, "The Messenger of Allah ﷺ ruled that the right of preemption applies to every joint holding not yet divided, whether a house or a garden. It is not permissible for him to sell until he notifies his partner. If the partner wishes, he may take it, and if he wishes, he may leave it. But if he sells without notifying him, then the partner has the greater right to it."Zuhayr Abu Khaythama is Ibn Muawiya al-Jufi.
