The Prophet ﷺ said, "Whoever cultivates land that belongs to no one has the better right to it."Urwa said, Umar ruled by this during his caliphate.
عن النبي ﷺ قال: من أعمر أرضا ليست لأحد فهو أحق. قال عروة قضى به عمر-رضي الله عنه- في خلافته.
Bukhari narrated it in "Cultivation and Sharecropping" (2335) from Yahya bin Bukayr, who said, Layth told us, from Ubaydullah bin Abu Jafar, from Muhammad bin Abdul-Rahman, from Urwa, from Ayesha, who said, and then she mentioned it.Tabarani narrated it in Al-Awsat, Majma Bahrayn (2178) from Muhammad bin Rashid, who said, Isam bin Rawwad bin Jarra told us, who said, my father told us, who said, Nafi bin Umar told us, from Ibn Abu Mulayka, from Urwa bin Zubayr, from Ayesha, that she heard the Messenger of Allah ﷺ say, "Whoever revives dead land, it belongs to him, and an unjust root has no right."Its chain is hasan because of Isam bin Rawwad bin Jarra and his father, for the two of them make the hadith hasan. Tabarani's teacher Muhammad bin Rashid is Muhammad bin Ahmad bin Rashid bin Madan, Abu Bakr Thaqafi. Safadi said of him, he died in Kirman in the year three hundred and nine, and he was righteous and trustworthy.
