The Messenger of Allah ﷺ ruled that the right of pre-emption applies to property that has not yet been divided. Once the boundaries have been set, there is no pre-emption.
أن رسول الله ﷺ قضى بالشفعة فيما لم يقسم، فإذا وقعت الحدود فلا شفعة.
Ibn Majah (2497) narrated it from Muhammad bin Yahya and Abdul-Rahman bin Umar, who said, Abu Asim narrated to us, who said, Malik bin Anas narrated to us, from Zuhri, from Saeed bin Musayab and Abu Salama bin Abdul-Rahman, from Abu Hurairah, and he mentioned the hadith. Bayhaqi (6/104) likewise narrated it from Abu Asim, from Malik, as connected. Abdullah bin Abdul-Aziz Majishun followed him in this, and from his route Ibn Hibban narrated it in his Sahih (5185), as did Bayhaqi. Likewise Yahya bin Abdul-Rahman bin Abu Qatila, and Dahhak bin Makhlad Shaybani, as found in Bayhaqi.Ibn Hibban said, "Four individuals raised this report from Malik as connected, Majishun, Abu Asim, Yahya bin Abu Qatila, and Ashhab bin Abdul-Aziz." He did not mention Dahhak bin Makhlad among them, so the number becomes five. He said, "The rest of his companions transmitted it from Malik as mursal. This was Malik's habit, he would raise reports to marfu at times, make them mawquf at other times, transmit them as mursal once and as musnad another time, depending on his disposition at the time. The ruling always belongs to whoever raised it to marfu and connected it, provided he is a trustworthy, precise, and accurate memorizer, following the method we described at the beginning of the book."Ibn Abdul-Barr said in Tamhid (7/36), "This is how most narrators of the Muwatta and others narrated this hadith from Malik, as mursal, except Abdul-Malik bin Abdul-Aziz Majishun, Abu Asim Nabil, Yahya bin Ibrahim bin Dawud bin Abu Qatila Madani, Abu Yusuf the judge, and Saeed Zinbari, for they narrated it from Malik with this chain as connected, from Abu Hurairah, as musnad."Among those who transmitted this hadith from Abu Hurairah as musnad is Abu Dawud (3515), from the hadith of Muhammad bin Idris Shafii, from Ibn Jurayj, from Ibn Shihab Zuhri, from Abu Salama or Saeed bin Musayab, or from both of them together, from Abu Hurairah, and he mentioned the hadith in full.As for those who narrated it from Malik as mursal, among them is Waki, from him, from Zuhri, from Saeed bin Musayab and Abu Salama, who said, and he mentioned the hadith. Ibn Abu Shayba (7/171) narrated it through this route. Among them also is Yahya, from him with his chain, and this is what appears in his Muwatta in the book of preemption (1), and likewise in the Muwatta of Qanabi and others.Bayhaqi said, "Malik narrated it in the Muwatta as mursal, and it has been narrated from him through other routes as connected, mentioning Abu Hurairah in it."I say, among those who also narrated it as mursal is Mamar, from Zuhri, from Abu Salama, and through his route Nasai narrated it. Muslim narrated it as connected, mentioning Jabir bin Abdullah, as has already passed.The conclusion regarding it is that the ruling belongs to whoever narrated it as musnad, as Ibn Hibban said.
