The Messenger of Allah ﷺ said, "The right of pre-emption applies to every shared property, whether land, a dwelling, or a walled garden. It is not permissible for a partner to sell until he offers it to his co-partner, who may then take it or leave it. If he refuses to make the offer, his partner still has the greater right to it until he is notified."
قال رسول الله ﷺ: الشفعة في كل شرك، في أرض، أو ربع، أو حائط لا يصلح أن يبيع حتى يعرض على شريكه، فيأخذ، أو يدع، فإن أبى فشريكه أحق به حتى يؤذنه.
Muslim narrated it in the Book of Musaqah (1608: 135), from Abu Tahir, who said, Ibn Wahb informed us, from Ibn Jurayj, that Abu Zubayr informed him that he heard Jabir say the following, and he related it.In another version of his, from Abdullah bin Idris, from Ibn Jurayj, "The Messenger of Allah ﷺ ruled that pre-emption applies in every partnership that has not been divided, whether it is a dwelling or an orchard. It is not permissible for one partner to sell without informing his partner. If he wishes, he may take it, and if he wishes, he may leave it. But if he sells without informing him, then the partner has the greater right to it."
