The Prophet ﷺ ruled that the right of pre-emption applies to every property that has not yet been divided. Once boundaries have been set and roads have been laid out, there is no pre-emption.
قضى النبي ﷺ بالشفعة في كل ما لم يقسم، فإذا وقعت الحدود، وصرفت الطرق فلا شفعة.
Bukhari narrated it in the Chapter on Preemption (2257), from Musaddad, who said, Abdul-Wahid narrated to us, who said, Maamar narrated to us, from Zuhri, from Abu Salama bin Abdul-Rahman, from Jabir, who said, and then he related it.
