Umar bin Khattab ruled that the penalty for killing a hyena while in a state of ihram is a ram, for a gazelle a female goat, for a hare a young female goat, and for a jerboa a four-month-old kid.
قضى عمر بن الخطاب في الضبع بكبش، وفي الغزال بعنز، وفي الأرنب بعناق، وفي الجربوع بجفرة.
Malik narrated it in Muwatta according to Abu Musab's recension (1244), and Shaybani's recension (503), from Abu Zubayr, from Jabir. Shaybani said, "We adopt all of this, because this is like it among livestock." Yahya erred in his recension of the Muwatta (1/414) by dropping Jabir from the chain, because Shafii also narrated it in Al-Umm (2/192-193) from Malik and Sufyan bin Uyayna, both of them from Abu Zubayr, from Jabir. Likewise Bayhaqi narrated it (5/183) from Shafii, mentioning Jabir. It was also narrated by Abdul-Malik bin Abu Sulayman, from Ataa, from Jabir, from Umar bin Khattab, who related it, in similar wording.As for what Daraqutni narrated in his Sunan (2546, 2549), by two routes from Ibn Fudayl and Abu Maryam, both of them from Ajlah bin Abdullah, "Abu Zubayr narrated to me, from Jabir, from the Prophet ﷺ," who said, "For the hyena, if the pilgrim in Muharram kills it, a ram, for the gazelle a sheep, for the hare a female kid goat, and for the jerboa a young female kid," this is a flawed narration. Ajlah bin Abdullah bin Hujayya is disputed, and the summary regarding him is that his hadith is hasan when he does not contradict others, but here he has contradicted Malik, Ibn Uyayna, and others regarding making it a statement of the Prophet. The correct view is that it stops at Umar bin Khattab , and this is also what Bayhaqi favored.
