Juwayria bint Harith bin Mustaliq fell to the share of Thabit bin Qays bin Shammas, or to a cousin of his, and she made a contract for her freedom. She was a beautiful woman, captivating to the eye.Ayesha said, "She came to ask the Messenger of Allah ﷺ for help with her freedom contract. When she stood at the door, I disliked her presence the moment I saw her, for I knew that the Messenger of Allah ﷺ would see in her what I had seen."She said, "Messenger of Allah, I am Juwayria bint Harith. What has happened to me is not hidden from you. I fell to the share of Thabit bin Qays bin Shammas, and I made a contract for my freedom, so I have come to ask you for help with my contract."The Messenger of Allah ﷺ said, "Would you like something better than that?"She asked, "What is it, Messenger of Allah?"He said, "I will pay your contract for you and marry you."She said, "I accept."Ayesha continued, "Then the people heard that the Messenger of Allah ﷺ had married Juwayria, so they released the captives they held and freed them, saying, 'They are the in-laws of the Messenger of Allah ﷺ.' We have never seen a woman who brought greater blessing to her people than her. A hundred households from the Banu Mustaliq were freed on her account."Abu Dawud said, "This is proof that the guardian may give himself in marriage."
وقعت جويرية بنت الحارث بن المصطلق في سهم ثابت بن قيس بن شماس- أو ابن عم له- فكاتبت على نفسها وكانت امرأة ملاحة تأخذها العين. قالت عائشة رضي الله عنها: فجاءت تسأل رسول الله ﷺ في كتابتها فلما قامت على الباب فرأيتها كرهت مكانها وعرفت أن رسول الله ﷺ سيرى منها مثل الذي رأيت فقالت: يا رسول الله أنا جويرية بنت الحارث وإنما كان من أمري ما لا يخفى عليك وإني وقعت في سهم ثابت بن قيس بن شماس وإني كاتبت على نفسي فجئتك أسألك في كتابتي فقال رسول الله ﷺ: فهل لك إلى ما هو خير منه؟ قالت: وما هو يا رسول الله؟ قال: أؤدي عنك كتابتك وأتزوجك. قالت: قد فعلت. قالت فتسامع تعني الناس أن رسول الله ﷺ قد تزوج جويرية فأرسلوا ما في أيديهم من السبي فأعتقوهم وقالوا أصهار رسول الله ﷺ لا فما رأينا امرأة كانت أعظم بركة على قومها منها أعتق في سببها مائة أهل بيت من بني المصطلق. قال أبو داود هذا حجة في أن الولي هو يزوج نفسه.
Abu Dawud (3931) narrated it from Abdul-Aziz bin Yahya Abu Asbagh Harrani, who said, Muhammad, meaning Ibn Salama, narrated to us, from Muhammad bin Ishaq, from Muhammad bin Jafar bin Zubayr, from Urwa bin Zubayr, from Ayesha, and he related it.Its chain of transmission is hasan because of Muhammad bin Ishaq, who was a mudallis, but he explicitly stated that he heard it directly in the version narrated by Imam Ahmad (26265). Ibn Hibban (4054) and Hakim (4/26) both graded it sahih, both coming through the route of Ibn Ishaq with his chain of transmission, in a similar wording. Hakim also narrated it, in the same place mentioned above, through another route from Muhammad bin Abdul-Rahman bin Thawban, from Ayesha, in similar wording.
