The Prophet ﷺ said, "The fornicator is not a believer at the moment he commits fornication, the drinker of wine is not a believer at the moment he drinks it, and the thief is not a believer at the moment he steals."
أن النبي ﷺ قال: لا يزني الزاني حين يزني وهو مؤمن ولا يشرب الخمر حين يشربها وهو مؤمن، ولا يسرق السارق حين يسرق وهو مؤمن.
Bukhari narrated it in the Book of Drinks (5578), and Muslim in the Book of Faith (57), both of them from Ibn Wahb, who said, "Yunus told me, from Ibn Shihab, who said, 'I heard Abu Salama bin Abdul-Rahman and Ibn Musayab say, "Abu Hurairah said..."'" and he mentioned the hadith.Ibn Shihab said, "Abdul-Malik bin Abu Bakr bin Abdul-Rahman bin Harith bin Hisham told me that Abu Bakr used to narrate to him from Abu Hurairah, then he would say, 'Abu Bakr used to add along with these, "Nor does he plunder a valuable plunder that people raise their eyes toward while he plunders it, while he is a believer."'"The apparent meaning is that his statement, "Nor does he plunder... etc." is not marfu, but rather is from Abu Hurairah's own words. This is contradicted by what Bukhari narrated in the Book of Grievances (2475) from the hadith of Layth, from Aqeel, from Ibn Shihab, from Abu Bakr bin Abdul-Rahman, from Abu Hurairah, mentioning the hadith complete and in one sequence. Its wording is, "The adulterer does not commit adultery while he is a believer, nor does he drink wine while he is a believer, nor does he steal while he is a believer, nor does he plunder a plunder that people raise their eyes toward while he plunders it, while he is a believer." Thus he made the whole of it marfu.Muslim also narrated it via the route of Layth bin Saad, with his chain, from Abu Hurairah, that he said, the Messenger of Allah ﷺ said, "The adulterer does not commit adultery..." and he related the rest of the hadith in the same way, mentioning the plunder along with it, but without mentioning "valuable."In a narration of his, in the hadith of Hammam, it reads, "the believers raise their eyes toward it, and he, when he plunders it, is a believer," with the addition, "Nor does any of you embezzle while he embezzles, and he is a believer. So beware, beware."And in a narration of his, in the hadith of Zakwan from Abu Hurairah, "The adulterer does not commit adultery while he is a believer, nor does he steal while he is a believer, nor does he drink wine while he drinks it while he is a believer, and repentance is offered afterward."The conclusion is that the statement of Abu Bakr bin Abdul-Rahman, "Abu Hurairah used to add along with these," means that he added it as a narration from the Messenger of Allah ﷺ, not from himself, and it seems Abu Bakr singled it out for this because it had reached him that no one else was narrating it. Siyanat Sahih Muslim (p. 227).Tirmidhi said, after narrating the hadith of Abu Hurairah, "It has also been narrated from Abu Hurairah, from the Prophet ﷺ, that he said, 'When the servant commits adultery, faith departs from him and remains above his head like a canopy, and when he departs from that act, faith returns to him.'" He narrated it in this way as muallaq, and it will come later with a full chain.
