We came to the Prophet of Allah ﷺ, and a man who appeared to be a bedouin came and asked, "Prophet of Allah, what do you say about a man touching his private part after he has performed ablution?"He replied, "Is it anything other than a piece of him?" Or he said, "A part of him."
Abu Dawud (183) and Tirmidhi (85) narrated it, and the wording is theirs, and Nasai (165) also narrated it, with the wording, "Until we came to the Messenger of Allah, and we gave him our allegiance and prayed with him. When the prayer ended, a man who seemed to be a bedouin came and said, 'O Messenger of Allah, what do you say about a man who touches his penis during prayer?' He said, 'Is it anything but a piece of flesh from you, or a part of you?'" All of them narrated it from the hadith of Mulazim bin Amr Hanafi, who said, Abdullah bin Badr narrated to us, from Qays bin Talq, with this same wording. Its isnad is hasan, because of Qays bin Talq. Zafarani reported from Shafii that he said, "We asked about Qays, but we did not find anyone who knew him well enough for us to accept his report." Bayhaqi mentioned this (1/135). But others did know him, Ibn Main, Ajli, and Ibn Hibban all deemed him trustworthy, and Hafiz placed him in the rank of "truthful."The hadith has another isnad narrated by Ibn Majah (483). Ali bin Muhammad narrated to us, Waki narrated to us, Muhammad bin Jabir narrated to us, he said, I heard Qays bin Talq Hanafi say, from his father, who said, I heard the Messenger of Allah ﷺ being asked about touching the penis, and he said, "There is no wudu required for it, it is only a part of you."Tirmidhi said, "It has been narrated from more than one of the companions of the Prophet ﷺ and some of the successors that they did not consider wudu necessary for touching the penis, and this is the view of the people of Kufa and Ibn Mubarak. This hadith is the best thing narrated on this topic. Ayub bin Utba and Muhammad bin Jabir narrated this hadith from Qays bin Talq from his father. Some scholars of hadith have criticized Muhammad bin Jabir and Ayub bin Utba. The hadith of Mulazim bin Amr from Abdullah bin Badr is more sahih and better."His saying "mudghah," with a damma on the mim, means a mouthful sized piece of flesh. His saying "bidah," with a fatha on the ba, means a piece of flesh larger than the mudghah.See for more, Minna Kubra (1/43–53), where I discussed this topic in detail, praise be to Allah, so refer to it if you wish. Its summary is that if the touching is with desire, the wudu is invalidated, and if it is without desire, the wudu is not invalidated. This is preferable to the view of those who said that the hadith of Talq bin Ali is abrogated by the hadith of Busra.
