Bukhari narrated it in the Book of Faith (48), and Muslim in the Book of Faith (64), both from the hadith of Shubah, from Zubayd, from Abu Waail, from Abdullah bin Masud, and he mentioned the hadith. Zubayd said, I said to Abu Waail, "Did you hear it from Abdullah, narrating it from the Messenger of Allah ﷺ?" He said, "Yes."Regarding his statement, "fighting him is disbelief," Baghawi said in Sharh al-Sunnah (13/130), "This is only when one considers his blood lawful and does not regard Islam as a protection for his blood, for this constitutes apostasy from him and actual disbelief. It may also be applied by way of likening their actions to the actions of disbelievers, without actual disbelief being meant, when he kills him for a reason other than making his blood lawful, as ﷺ said, 'Do not return after me to being disbelievers, striking one another's necks,' meaning, do not become people who consider that lawful, like those whose habit that is."
