Saeed bin Jubayr reported,

Abdul-Rahman bin Abza instructed me, saying, "Ask Ibn Abbas about these two verses, what is their ruling? 'And do not kill the soul which Allah has forbidden' [Isra 17:33], and 'Whoever kills a believer intentionally'."So I asked Ibn Abbas, and he said, "When the verse in al-Furqan was revealed, 'And those who do not invoke with Allah another deity, nor kill the soul which Allah has forbidden except by right, nor commit unlawful sexual intercourse. And whoever should do that will meet a penalty' [Furqan 25:68], the polytheists of Mecca said, 'We have already killed the soul which Allah has forbidden, invoked another deity along with Allah, and committed indecencies.' So Allah revealed, 'Except for those who repent, believe, and do righteous deeds' [Furqan 25:70]. This applies to those people.As for the verse in an-Nisa, 'Whoever kills a believer intentionally, his recompense is Hell, wherein he will abide eternally, and Allah has become angry with him and has cursed him and has prepared for him a great punishment' [Nisa 4:93], this concerns a man who, after coming to know Islam and its laws, then commits murder. His recompense is Hell."I mentioned this to Mujahid, and he said, "Except for one who repents."

عن سعيد بن جبير قال

أمرني عبد الرحمن بن أبزى، قال: سل ابن عباس عن هاتين الآيتين، ما أمرهما {ولا تقتلوا النفس التي حرم الله} [سورة الإسراء: ٣٣] {ومن يقتل مؤمنا متعمدا}، فسألت ابن عباس، فقال: لما أنزلت التي في الفرقان: {والذين لا يدعون مع الله إليها ءاخر ولا يقتلون النفس التي حرم الله إلا بالحق ولا يزنون ومن يفعل ذلك يلق أثاما} [سورة الفرقان: ٦٨] قال مشركو أهل مكة: قد قتلنا النفس التي حرم الله، ودعونا مع الله إلها آخر، وقد آتينا الفواحش، فأنزل الله: {إلا من تاب وءامن} [الفرقان: ٧٠] فهذه لأولئك، وأما التي في النساء: {ومن يقتل مؤمنا متعمدا فجزاؤه جهنم خلدا فيها وغضب الله عليه ولعنه وأعد له عذابا عظيما} فالرجل إذا عرف الإسلام وشرائعه ثم قتل، فجزاؤه جهنم. فذكرته لمجاهد فقال: إلا من ندم.
