She is entitled to the full dowry, she must observe the waiting period, and she has the right of inheritance.Maqil bin Sinan said, "I heard that the Messenger of Allah ﷺ gave the same ruling in the case of Birwa bint Washiq."
في رجل تزوج امرأة فمات عنها، ولم يدخل بها، ولم يفرض لها الصداق.
لها الصداق كاملا، وعليها العدة، ولها الميراث. قال معقل بن سنان: سمعت رسول الله ﷺ قضى في بروع بنت واشق.
Reported by Abu Dawud (2114), Nasai (3356), and Ibn Majah (1891), and graded sahih by Ibn Hibban (4098) and Hakim (2/180–181), all of them from the hadith of Abdul-Rahman bin Mahdi, from Sufyan, from Firas, from Shaybi, from Masruq, from Abdullah, who related it. Tirmidhi (1145) also reported it through another route, from Ibn Masud, and said, "This is a hasan sahih hadith."His statement, "four months and ten [days]" [Baqarah 2:234], means that the waiting period for a woman whose husband has died, if she is not pregnant, is four months and ten days. Excepted from this is the female slave, whose waiting period is half that of a free woman, namely two months and five nights, according to the view of the majority of scholars. Some scholars disagreed with them, saying there is no difference between the free woman and the slave woman in the waiting period, because the purpose of the waiting period is to confirm that the womb is free of pregnancy, and both the free woman and the slave woman share equally in that concern.Among the rulings related to this waiting period are the following.1. She must remain in the house in which her husband died, living in it, unless the house was rented or owned by someone other than the husband, in which case she may go out to her family's house.2. She should not leave her house except for a need or necessity, such as visiting the hospital or carrying out her job duties, and once her need is finished she returns to her house, and night and day are the same in this regard.3. She should avoid all types of perfume and the like, unless she has become pure from her menstruation, in which case there is no harm in her fumigating herself with incense or other perfume, and there is no objection to her offering perfume to her family or guests without joining them in using it herself.4. She should avoid jewelry made of gold, silver, diamonds, and the like, whether necklaces, bracelets, even a ring, or anything else.5. She should avoid using henna, kohl, and anything resembling kohl, and likewise she should avoid all types of adornment.6. She should avoid beautiful clothing and wear other than that.As for the pregnant woman whose husband has died, the most sahih of the scholars' opinions is that her waiting period is until she delivers her child.
