The Messenger of Allah ﷺ said, "A previously married woman must be consulted regarding herself, and a virgin must have her permission sought."They asked, "Messenger of Allah, how is her permission given?"He replied, "By her remaining silent."
حدثنا إسماعيل حدثنا الحجاج بن أبي عثمان عن يحيى بن أبي كثير عن أبي سلمة
قال رسول الله ﷺ الثيب تستأمر في نفسها والبكر تستأذن قالوا يا رسول الله كيف إذنها قال أن تسكت
Its isnad is sahih. Ismail is Ibn Ibrahim, known as Ibn Ulaya. Hajjaj bin Abu Uthman Sawwaf, his reliability was already established at 3423 and 4627, and we add here that Ibn Saad gave his biography at 31/2/7, as did Ibn Abu Hatim at 166/2/1–167. The hadith is a repetition of 7131, and we have already documented it there. Muslim narrated it from this very route, 1:400, from Zuhayr bin Harb, from Ibn Ulaya, from Hajjaj Sawwaf, and through multiple chains, all of them from Yahya bin Abu Kathir.
