The Prophet ﷺ said, "The major sins are associating partners with Allah , disobedience to one's parents," or "killing a soul." Shuba was the one uncertain. "And the false oath that plunges its swearer into sin."
حدثنا محمد بن جعفر حدثنا شعبة عن فراس عن الشعبي
عن النبي ﷺ أنه قال الكبائر الإشراك بالله عز وجل وعقوق الوالدين أو قتل النفس شعبة الشاك واليمين الغموس
Its isnad is sahih. Firas is Ibn Yahya Hamdani, whose reliability was previously established at 4333. Bukhari narrated the hadith at 11:482-483 and 12:170, Tirmidhi at 4:87-88, and Nasai at 2:165, 254, all of them through Shubah, from him. However, Nasai's version does not contain Shubah's doubt. It appears that Shubah sometimes expressed doubt and sometimes stated it with certainty.This is supported by the fact that Abu Naeem narrated it in the Hilyah, 7:202, through Dawud bin Ibrahim Wasiti, from Shubah, and said at its beginning, "The major sins are four," and then mentioned them. Abu Naeem said, "What is established as sahih is from the hadith of Shubah and Firas."As for Dawud bin Ibrahim Wasiti, Bukhari gave him a biographical entry in al-Kabir, 12/1/216, without mentioning any criticism of him. Al-Hafiz said in al-Tajil, 118, "Ibn Hibban mentioned him among the trustworthy narrators." And he said in Lisan Mizan, 2:415, "Tayalisi deemed him trustworthy and narrated from him."Regarding "al-yamin al-ghamus" (the false, plunging oath), Ibn Athir said, "It is the false, wicked oath, such as the one by which the one swearing seizes another's property. It is called ghamus because it plunges its owner into sin, and then into the Fire. It has also been said that the name is for emphasis."In al-Fath, 11:482, quoting Ibn Tin, "For this reason Malik said there is no expiation for it." He also cited as evidence Allah's saying, "But He holds you accountable for oaths made in earnest" [Maidah 5:89], for this oath is not one that has been properly contracted, since a contracted oath is one that can be dissolved, and no fulfillment can ever come from the plunging oath in the first place.
