The Messenger of Allah ﷺ said, "Whoever takes up arms against us is not one of us, nor is one who lies in ambush on the road. Whoever is killed in circumstances other than that, his case is quasi-intentional homicide. The blood-money for it is heavy, but the killer is not put to death. It is like the sacred month, sharing in the inviolability and the protection of neighbors."

أن رسول الله ﷺ قال من حمل علينا السلاح فليس منا ولا رصد بطريق ومن قتل على غير ذلك فهو شبه العمد وعقله مغلظ ولا يقتل صاحبه وهو كالشهر الحرام للحرمة والجوار
