Muhammad ﷺ ruled that debt takes precedence over bequests, even though you recite the bequest before the debt in the verse, and that full siblings born of the same mother inherit from one another to the exclusion of half-siblings born of different mothers.
حدثنا سفيان عن أبي إسحاق عن الحارث
قضى محمد ﷺ أن الدين قبل الوصية وأنتم تقرءون الوصية قبل الدين وأن أعيان بني الأم يتوارثون دون بني العلات
Its chain of transmission is daif because of Harith Awar. Sufyan here is Ibn Uyayna, and the hadith will also come later from Waki from Sufyan Thawri from Abu Ishaq, 1091.Tirmidhi related it both at length and in abridged form, 4:179, 190, and said, "This is a hadith we know only through the report of Abu Ishaq from Harith from Ali, and some scholars have raised criticism about Harith. The practice among scholars is in accordance with this hadith."Ibn Kathir, in his tafsir, also attributed it to Ibn Majah, 2:368, and said regarding Harith, "However, he was one who preserved the rules of inheritance and was devoted to them and to calculation." Ibn Kathir also said, "The scholars, both past and present, are unanimously agreed that debt takes precedence over bequest, and upon careful reflection this is understood from the sense of the noble verse."Aayan bani al-Umm means full brothers, those from one father and one mother, the word being taken from "the essence of a thing," meaning its most precious part. Banu al-Allat, with fatha on the ayn, means those whose mothers differ but whose father is one. The point is that when they come together, the full brothers inherit to the exclusion of the paternal half-brothers.
