The Messenger of Allah ﷺ said, "Whoever frees his share in a slave, if he has enough wealth to cover the slave's full value, a fair price shall be set and he must pay the rest. Otherwise, only the portion he has freed is freed."
حدثنا عفان حدثنا جرير بن حازم سمعت نافعا
أن رسول الله ﷺ قال من أعتق نصيبا له في عبد فإن كان له من المال ما يبلغ قيمته قوم عليه قيمة عدل وإلا فقد أعتق ما أعتق
Its chain of transmission is sahih, and it is a repetition of 5474.Regarding "shaqisan" (a share), Ibn Athir said, "Ash-shaqis is the portion in something jointly owned, of anything."In manuscript H it is replaced with "nasiban" (a portion), and this is also a variant found in the margin of manuscripts M and K.Regarding "freed what he freed," in a variant in the margin of manuscript M it reads "was freed what was freed."And in a variant in manuscript K it reads "freed part of it," with the word "of it" added.
