A man came to Abdullah bin Masud and asked him about a man who married a woman without specifying a dowry for her, then died before consummating the marriage. He gave no answer about the matter, so they left. Then they came back to him and asked him again.He said, "I will give my best judgment on this. If I am correct, then Allah has guided me to it, and if I am wrong, then the error is from me. She is entitled to a dowry equal to that of her peers, she inherits from him, and she must observe the waiting period."A man from the tribe of Ashja then stood up and said, "I bear witness that the Prophet ﷺ gave exactly this ruling."Abdullah bin Masud said, "Bring forward someone who will support your testimony."So Abu al-Jarrah testified to the same.
قال قرأت على يحيى بن سعيد عن هشام حدثنا قتادة عن خلاس
أتي عبد الله بن مسعود فسئل عن رجل تزوج امرأة ولم يكن سمى لها صداقا فمات قبل أن يدخل بها فلم يقل فيها شيئا فرجعوا ثم أتوه فسألوه فقال سأقول فيها بجهد رأيي فإن أصبت فالله عز وجل يوفقني لذلك وإن أخطأت فهو مني لها صداق نسائها ولها الميراث وعليها العدة فقام رجل من أشجع فقال أشهد على النبي ﷺ أنه قضى بذلك قال هلم من يشهد لك بذلك فشهد أبو الجراح بذلك
Its isnad is sahih. Khilas, with a short vowel on the kha and a light lam, is Ibn Amr Hijri Basri, a trustworthy successor. The authors of the six books cited him, and Bukhari gave his biography in Tarikh al-Kabir 1/2/208.Abdullah bin Utbah is Abdullah bin Utbah bin Masud, nephew of Abdullah bin Masud. He was a senior, trustworthy, eminent successor, prolific in hadith and legal rulings, a jurist, born in the time of the Messenger of Allah ﷺ. Some even mentioned him among the companions.The hadith was narrated by Abu Dawud 2:202–203 through Khilas and Abu Hassan from Abdullah bin Utbah, 4276, and he also narrated it through Masruq from Ibn Masud, and through Alqama from Ibn Masud. It will also come through her narration and that of Aswad, in the musnad of Jarrah and Abu Sinan Ashjaee in this musnad (vol. 4, pp. 279–280h). Likewise, the musnad of Maqil bin Sinan Ashjaee will come through the narration of Alqama, 16009.Munziri said, Tirmidhi, Nasai, and Ibn Majah narrated it. Tirmidhi said, this is a hasan sahih hadith.
