The Prophet ﷺ gave judgment based on an oath together with a single witness.Zayd bin Hubab said, I asked Malik bin Anas about an oath with a single witness, whether it is permissible in matters of divorce and emancipation. He replied, "No, this applies only to buying, selling, and similar transactions."
حدثنا زيد بن الحباب أخبرني سيف بن سليمان المكي عن قيس بن سعد المكي عن عمرو بن دينار
أن النبي ﷺ قضى بيمين وشاهد قال زيد بن الحباب سألت مالك بن أنس عن اليمين والشاهد هل يجوز في الطلاق والعتاق فقال لا إنما هذا في الشراء والبيع وأشباهه
