I came to the Messenger of Allah ﷺ while he was at al-Batha, and he asked, "With what intention have you entered ihram?"I replied, "With the same intention as the Prophet ﷺ."He asked, "Have you brought any sacrificial animal with you?"I said, "No."He said, "Then perform tawaf around the Kaaba and walk between Safa and Marwa, then exit ihram."So I performed tawaf around the Kaaba and walked between Safa and Marwa, then I went to a woman from my people, who combed my hair and washed my head.I used to give this same legal opinion to people during the rule of Abu Bakr and the rule of Umar
. Then, while I was standing during the Hajj season, a man came to me and said, "You do not know what the Commander of the Believers has newly introduced regarding the rites of pilgrimage."So I said, "People, whoever we have given a ruling to, here is the Commander of the Believers coming to you, so follow him."When Umar arrived, I asked, "What is this that you have newly introduced regarding the rites of pilgrimage?"He replied, "If we take the Book of Allah, then Allah Almighty has said, 'And complete the Hajj and Umrah for Allah' [Baqarah 2:196]. And if we take the Sunnah of our Prophet, then he did not exit ihram until he had sacrificed his offering."
حدثنا عبد الرحمن حدثنا سفيان عن قيس بن مسلم عن طارق بن شهاب
قدمت على رسول الله ﷺ وهو بالبطحاء فقال بم أهللت قلت بإهلال كإهلال النبي ﷺ فقال هل سقت من هدي قلت لا قال طف بالبيت وبالصفا والمروة ثم حل فطفت بالبيت وبالصفا والمروة ثم أتيت امرأة من قومي فمشطتني وغسلت رأسي فكنت أفتي الناس بذلك بإمارة أبي بكر رضي الله عنه وإمارة عمر رضي الله عنه فإني لقائم في الموسم إذ جاءني رجل فقال إنك لا تدري ما أحدث أمير المؤمنين في شأن النسك فقلت أيها الناس من كنا أفتيناه فتيا فهذا أمير المؤمنين قادم عليكم فبه فأتموا فلما قدم قلت ما هذا الذي قد أحدثت في شأن النسك قال إن نأخذ بكتاب الله تعالى فإن الله تعالى قال {وأتموا الحج والعمرة لله} وإن نأخذ بسنة نبينا فإنه لم يحل حتى نحر الهدي
Its isnad is sahih, and it will come again in the Musnad of Abu Musa Ashari at greater length than this (4:393h). Suyuti attributed it in Durr Manthur 1:216 to Bukhari, Muslim, and Nasai. Abdul-Rahman is Ibn Mahdi.
