Ayesha reported that Barirah came to her seeking help with her contract of manumission. Ayesha, feeling sympathy for her, said to her, "What do you think if I pay your owners the full amount in one lump sum? Would they agree to that, and I would free you, so you would become my freedwoman?"Barirah went to her owners and presented this to them, but they said, "No, unless your right of guardianship belongs to us."Ayesha said, the Messenger of Allah ﷺ then came in to me, and I mentioned this to him. The Messenger of Allah ﷺ said, "Buy her and free her, for the right of guardianship belongs to the one who frees the slave."Then the Messenger of Allah ﷺ stood up that evening and said, "What is the matter with some men who stipulate conditions that are not in the Book of Allah? Whoever stipulates a condition that is not in the Book of Allah, it is invalid, even if he stipulates it a hundred times. Allah's condition is more deserving and more binding."
حدثنا يعقوب قال حدثنا ابن أخي ابن شهاب عن عمه قال أخبرني عروة بن الزبير أن
أخبرته أن بريرة دخلت عليها تستعينها في كتابتها فقالت لها عائشة ونفست فيها أرأيت إن عديت لأهلك الذي عليك عدة واحدة أيفعلن ذلك وأعتقك فتكوني مولاتي فذهبت بريرة إلى أهلها فعرضت ذلك عليهم فقالوا لا إلا أن يكون ولاؤك لنا قالت عائشة فدخل علي رسول الله ﷺ فذكرت له ذلك فقال رسول الله ﷺ اشتري فأعتقي فإن الولاء لمن أعتق ثم قام رسول الله ﷺ عشية فقال ما بال رجال يشترطون شروطا ليست في كتاب الله ألا من اشترط شرطا ليس في كتاب الله فليس له وإن اشترط مائة مرة شرط الله أحق وأوثق
