The Messenger of Allah ﷺ ruled that the yield belongs to the one who bears the liability. I heard this from Quran bin Tammam in the year one hundred and eighty-one, when Ibn Mubarak was still alive. Ibn Mubarak died in that same year.
حدثنا قران بن تمام عن ابن أبي ذئب عن مخلد بن خفاف عن عروة
قضى رسول الله ﷺ أن الغلة بالضمان سمعت من قران بن تمام في سنة إحدى وثمانين ومائة وكان ابن المبارك باقيا وفيها مات ابن المبارك
