I asked Qays bin Saad about the charity of Fitr, and he said, "The Messenger of Allah ﷺ commanded us to give it before the obligation of zakat was revealed. Then zakat was revealed, and we were neither forbidden from it nor commanded to do it, yet we still practice it."I also asked him about fasting on Ashura, and he said, "The Messenger of Allah ﷺ commanded us to fast it before the obligation of Ramadan was revealed. Then Ramadan was revealed, and we were neither commanded to fast it nor forbidden from it, yet we still observe it."
حدثنا يزيد بن هارون أنبأنا سفيان الثوري عن سلمة بن كهيل عن القاسم بن مخيمرة
سألت قيس بن سعد عن صدقة الفطر فقال أمرنا رسول الله ﷺ قبل أن تنزل الزكاة ثم نزلت الزكاة فلم ننه عنها ولم نؤمر بها ونحن نفعله وسألته عن صوم عاشوراء فقال أمرنا رسول الله ﷺ قبل أن ينزل رمضان ثم نزل رمضان فلم نؤمر به ولم ننه عنه ونحن نفعله
