A man from Kindah and a man from Hadramawt brought a dispute before the Messenger of Allah ﷺ concerning a piece of land in Yemen.The Hadrami said, "Messenger of Allah, this man and his father seized my land."The Kindi said, "Messenger of Allah, it is my land, which I inherited from my father."The Hadrami said, "Messenger of Allah, have him swear an oath that he does not know it to be my land and my father's land, and that it was his father who seized it."The Kindi prepared to take the oath. The Messenger of Allah ﷺ said, "No servant, or no man, takes another's property by his oath without meeting Allah on the Day he meets Him with his hand cut off."The Kindi then said, "It is his land and his father's land."
حدثنا عبد الله بن نمير حدثنا الحارث بن سليمان حدثنا كردوس
أن رجلا من كندة ورجلا من حضرموت اختصما إلى رسول الله ﷺ في أرض باليمن فقال الحضرمي يا رسول الله أرضي اغتصبها هذا وأبوه فقال الكندي يا رسول الله أرضي ورثتها من أبي فقال الحضرمي يا رسول الله استحلفه أنه ما يعلم أنها أرضي وأرض والدي والذي اغتصبها أبوه فتهيأ الكندي لليمين فقال رسول الله ﷺ إنه لا يقتطع عبد أو رجل بيمينه مالا إلا لقي الله يوم يلقاه وهو أجذم فقال الكندي هي أرضه وأرض والده
