A man went out on a military expedition, taking with him a slave-girl belonging to his wife, and he had relations with her. The matter was mentioned to the Prophet ﷺ, who said, "If he forced her, then she is set free, and he must give his wife a slave-girl like her. If she consented, then she remains his wife's slave, and he must still give her a slave-girl like her."Ismail once said, "A man was on a military expedition."
حدثنا إسماعيل عن يونس عن الحسن
أن رجلا خرج في غزاة ومعه جارية لامرأته فوقع بها فذكر للنبي ﷺ فقال إن كان استكرهها فهي عتيقة ولها عليه مثلها وإن كانت طاوعته فهي أمته ولها عليه مثلها وقال إسماعيل مرة إن رجلا كان في غزوة
