A man had relations with his wife's slave girl while he was away on a military campaign. The matter was brought before the Prophet ﷺ, who ruled, "If he forced her, she is free, and he must pay her price from his own wealth to her mistress. If she consented, then he must give her mistress a slave girl of equivalent value from his own wealth."
حدثنا عبد الله بن بكر حدثنا سعيد يعني ابن أبي عروبة عن قتادة عن الحسن
أن رجلا غشي جارية امرأته وهو في غزو فرفع ذلك إلى النبي ﷺ فقال إن كان استكرهها فهي حرة من ماله وعليه شراؤها لسيدتها وإن كانت طاوعته فمثلها من ماله لسيدتها
