Imran bin Husayn reported,

Ubays, or Ibn Ubays, came to him along with a group of men from Banu Jusham. One of them asked him, "Will you not fight until there is no more discord?"Ali replied, "I have already fought until there was no more discord. Shall I tell you what the Messenger of Allah ﷺ said? Though I do not think it will benefit you. Listen carefully."He said, the Messenger of Allah ﷺ said, "Wage war against Banu so-and-so along with so-and-so."The men formed ranks, and the women were behind them. When they returned, one man said, "Prophet of Allah, ask forgiveness for me, may Allah forgive you."The Prophet asked, "Have you done something wrong?"The man replied, "When the enemy was defeated, I came upon a man between the fighters and the women, and he said, 'I am a Muslim,' or he said, 'I have submitted.' But I killed him."The Prophet said, "He sought refuge by saying that when the spear bore down upon him. Did you split open his heart to look inside?"The man replied, "No, by Allah, I did not."So the Prophet did not ask forgiveness for him, or words to that effect.In another version of the hadith, the Messenger of Allah ﷺ said, "Wage war against Banu so-and-so along with so-and-so."A man from my own kin went out with them. When he returned to the Prophet of Allah ﷺ, he said, "Prophet of Allah, ask Allah's forgiveness for me, may Allah forgive you."The Prophet asked, "Have you done something wrong?"The man replied, "When the enemy was defeated, I caught up with two men between the fighters and the women, and they said, 'We are Muslims,' or they said, 'We have submitted.' But I killed them."The Messenger of Allah ﷺ said, "I fight people for nothing other than Islam. By Allah, I will not ask forgiveness for you," or words to that effect.The man later died, and his clan buried him. By morning, the earth had cast him out. They buried him again and stood guard over him, but the earth cast him out a second time. They said, "Perhaps someone came while you were sleeping and dug him up." So they buried him a third time and stood guard, but the earth cast him out yet again. When they saw this, they simply threw him aside, or words to that effect.

حدثه أن عبيسا أو ابن عبيس في أناس من بني جشم أتوه فقال له أحدهم ألا تقاتل حتى لا تكون فتنة قال لعلي قد قاتلت حتى لم تكن فتنة قال ألا أحدثكم ما قال رسول الله ﷺ ولا أراه ينفعكم فأنصتوا قال قال رسول الله ﷺ اغزوا بني فلان مع فلان قال فصفت الرجال وكانت النساء من وراء الرجال ثم لما رجعوا قال رجل يا نبي الله استغفر لي غفر الله لك قال هل أحدثت قال لما هزم القوم وجدت رجلا بين القوم والنساء فقال إني مسلم أو قال أسلمت فقتلته قال تعوذا بذلك حين غشيه الرمح قال هل شققت عن قلبه تنظر إليه فقال لا والله ما فعلت فلم يستغفر له أو كما قال وقال في حديثه قال رسول الله ﷺ اغزوا بني فلان مع فلان فانطلق رجل من لحمتي معهم فلما رجع إلى نبي الله ﷺ قال يا نبي الله استغفر الله لي غفر الله لك قال وهل أحدثت قال لما هزم القوم أدركت رجلين بين القوم والنساء فقالا إنا مسلمان أو قالا أسلمنا فقتلتهما فقال رسول الله ﷺ عما أقاتل الناس إلا على الإسلام والله لا أستغفر لك أو كما قال فمات بعد فدفنته عشيرته فأصبح قد نبذته الأرض ثم دفنوه وحرسوه ثانية فنبذته الأرض ثم قالوا لعل أحدا جاء وأنتم نيام فأخرجه فدفنوه ثالثة ثم حرسوه فنبذته الأرض ثالثة فلما رأوا ذلك ألقوه أو كما قال
