A grandmother came to Abu Bakr, may Allah be pleased with him, asking him for her share of an inheritance.He said, "I know of nothing for you in the Book of Allah, and I know of nothing for you in the sunnah of the Messenger of Allah ﷺ, so let me ask the people."He asked them, and Mughira bin Shuba said, "I heard the Messenger of Allah ﷺ assign her a sixth."Abu Bakr asked, "Is there anyone who will testify along with you, or who knows this along with you?"Then Muhammad bin Maslama stood and said the same thing, so Abu Bakr granted it to her.Ishaq bin Isa's version has, "Is there anyone with you besides yourself?"
حدثنا إسحاق بن سليمان يعني الرازي قال سمعت مالك بن أنس وإسحاق بن عيسى قال أخبرني مالك عن الزهري عن عثمان بن خرشة قال أبي وقال إسحاق بن عيسى عن عثمان بن خرشة قال عبد الله وحدثنا مصعب الزبيري عن مالك مثله فقال عثمان بن إسحاق بن خرشة من بني عامر بن لؤي ولم يسنده عن الزهري أحد إلا مالك
جاءت الجدة إلى أبي بكر رضي الله تعالى عنه تسأله ميراثها فقال ما أعلم لك في كتاب الله شيئا ولا أعلم لك في سنة رسول الله ﷺ من شيء حتى أسأل الناس فسأل فقال المغيرة بن شعبة سمعت رسول الله ﷺ جعل لها السدس فقال من يشهد معك أو من يعلم معك فقام محمد بن مسلمة فقال مثل ذلك فأنفذه لها وقال إسحاق بن عيسى هل معك غيرك
Its isnad is sahih, coming through Ishaq bin Isa from Uthman bin Ishaq bin Kharsha, whom Ibn Main deemed trustworthy, though more sahih than it is the route of Malik from Zuhri. The hadith previously appeared at 17901.
