Malik bin Aws bin Hadathan reported,

Umar summoned him, and he mentioned the hadith. He said, "While I was with him, his chamberlain Yarfa came in and said, 'Will you receive Uthman, Abdul-Rahman, Zubayr, and Saad, who are seeking permission to enter?'Umar replied, "Yes," and admitted them. After a short while, Yarfa came again and said, "Will you receive Ali and Abbas, who are seeking permission to enter?"Umar said, "Yes," and gave them leave to enter.When they came in, Abbas said, "Commander of the Faithful, judge between me and this man," referring to Ali. The two were in dispute over the properties that Allah had granted as fay to His Messenger from the wealth of Banu Nadir.The group said, "Commander of the Faithful, decide between them and give each one rest from the other."Umar said, "Wait. I adjure you by Allah, by whose permission heaven and earth stand firm, do you know that the Prophet ﷺ said, 'We are not inherited from. Whatever we leave behind is charity,' meaning himself?"They said, "He did say that."Umar then turned to Ali and Abbas and said, "I adjure you by Allah, do you know that the Prophet ﷺ said that?"They both said, "Yes."Umar said, "Then let me tell you about this matter. Allah عز وجل singled out His Messenger in this fay with something He gave to no one else. He said, 'And whatever Allah restored to His Messenger from them, you did not spur on any horse or camel for it' [Hashr 59:6]. So this was exclusively for the Messenger of Allah ﷺ. Yet, by Allah, he did not hoard it apart from you, nor did he claim it for himself over you. He gave it to you and distributed it among you, until what remained of it was this property. The Messenger of Allah ﷺ used to take from this wealth the yearly maintenance of his family, then take what was left and place it where Allah's wealth is placed. The Messenger of Allah ﷺ acted in this way throughout his life. Then the Messenger of Allah ﷺ passed away, and Abu Bakr said, 'I am the successor of the Messenger of Allah ﷺ.' So Abu Bakr took charge of it and managed it as the Messenger of Allah ﷺ had managed it."

حدثنا أبو اليمان أنبأنا شعيب عن الزهري

أخبرني مالك بن أوس بن الحدثان النصري

أن عمر دعاه فذكر الحديث قال فبينا أنا عنده إذ جاء حاجبه يرفأ فقال هل لك في عثمان وعبد الرحمن والزبير وسعد يستأذنون قال نعم فأدخلهم فلبث قليلا ثم جاء فقال هل لك في علي وعباس يستأذنان قال نعم فأذن لهما فلما دخلا قال عباس يا أمير المؤمنين اقض بيني وبين هذا لعلي وهما يختصمان في الصواف التي أفاء الله على رسوله من أموال بني النضير فقال الرهط يا أمير المؤمنين اقض بينهما وأرح أحدهما من الآخر قال عمر اتئدوا أناشدكم بالله الذي بإذنه تقوم السماء والأرض هل تعلمون أن النبي ﷺ قال لا نورث ما تركنا صدقة يريد نفسه قالوا قد قال ذلك فأقبل عمر على علي وعلى العباس فقال أنشدكما بالله أتعلمان أن النبي ﷺ قال ذلك قالا نعم قال فإني أحدثكم عن هذا الأمر أن الله عز وجل كان خص رسوله في هذا الفيء بشيء لم يعطه أحدا غيره فقال {وما أفاء الله على رسوله منهم فما أوجفتم إلى قدير} فكانت هذه خاصة لرسول الله ﷺ ثم والله ما احتازها دونكم ولا استأثر بها عليكم لقد أعطاكموها وبثها فيكم حتى بقي منها هذا المال فكان رسول الله ﷺ ينفق على أهله نفقة سنتهم من هذا المال ثم يأخذ ما بقي فيجعله مجعل مال الله فعمل بذلك رسول الله ﷺ حياته ثم توفي رسول الله ﷺ فقال أبو بكر أنا ولي رسول الله ﷺ فقبضه أبو بكر فعمل فيه بما عمل فيه رسول الله ﷺ
