He sought out the ruling of the Messenger of Allah ﷺ concerning that, and Haml bin Malik bin Nabighah came forward and said, "I was between my two wives when one of them struck the other with a tent pole, killing her along with her unborn child."The Prophet ﷺ ruled that the blood-money for the unborn child was a male or female slave, and that the killer be put to death in retaliation for the woman.I said to Amr, "Did so-and-so not inform me from his father with such-and-such?"He replied, "You have made me doubt."
حدثنا عبد الرزاق قال أنا ابن جريج قال أنا عمرو بن دينار أنه سمع طاوسا يخبر عن ابن عباس
أنه نشد قضاء رسول الله ﷺ في ذلك فجاء حمل بن مالك بن النابغة فقال كنت بين بيتي امرأتي فضربت إحداهما الأخرى بمسطح فقتلتها وجنينها فقضى النبي ﷺ في جنينها بغرة وأن تقتل بها قلت لعمرو لا أخبرني عن أبيه بكذا وكذا قال لقد شككتني
Its isnad is sahih, its narrators are well-known and trustworthy. The hadith appears in the Sahihayn with a different wording, as noted earlier, and with its exact wording it was narrated by Abu Dawud 4/191, no. 4572, in the chapter on blood money, the blood money for a fetus, and Nasai 8/21, no. 4739, in the chapter on qasamah, killing a woman for a woman, and Ibn Majah 2/882, no. 2641, similar to Abu Dawud, and Darimi 2/258, no. 2381, similar to it.
