I heard some men relating from the Prophet ﷺ that he said, "When a slave-woman is set free, she has the choice as long as her husband has not had relations with her. If she wishes, she may leave him. But once he has had relations with her, she no longer has the choice and cannot separate from him."
قال حدثنا يحيى بن إسحاق قال حدثنا ابن لهيعة عن عبيد الله بن أبي جعفر
سمعت رجالا يتحدثون عن النبي ﷺ أنه قال إذا أعتقت الأمة فهي بالخيار ما لم يطأها إن شاءت فارقته وإن وطئها فلا خيار لها ولا تستطيع فراقه
Its chain is hasan because of Ibn Lahia. As for Ubaydullah bin Abu Jafar Misri Faqih, he is among the well-known trustworthy narrators, and his hadith is found among the group of hadith compilers.Fadl bin Amr bin Umaya is Damri. Ibn Hibban graded him trustworthy, while Bukhari and Abu Hatim were silent about him. As for his father, Amr bin Umaya Damri, he is a companion, and his hadith will come at 4/139, 179, 5/287 of the edition.The hadith was narrated by Abu Dawud, 2/271, no. 2236, in the chapter on divorce, on how long a female slave has the right of choice, and by Malik, 2/563, no. 27, in the chapter on divorce, on what has been reported concerning the right of choice.
