He found them mentioning that when the Messenger of Allah ﷺ prevailed over Khaybar and Khaybar became the property of the Messenger of Allah ﷺ and the Muslims, they were unable to manage its cultivation themselves, so they handed it over to the Jews to work and tend to it on the condition that they would receive half of its produce. The Messenger of Allah ﷺ divided it into thirty-six lots, each lot comprising one hundred shares. He allocated half of all of it to the Muslims, and within that half were the shares of the Muslims along with the share of the Messenger of Allah ﷺ. The other half he set aside for the delegations that would come to him, for various affairs, and for the unexpected needs of the people.
Its isnad is sahih. Muhammad bin Fudayl bin Ghazwan is trustworthy and his hadith is found in the collections of all the group, except that he was a Shia sympathizer. Yahya bin Saeed Ansari and Bashir bin Yasar Harithi the jurist are both well known and trustworthy. Abu Dawud narrated the hadith, 3/159, no. 3012, in the chapter on Kharaj, on what was said regarding the ruling on the land of Khaybar.
